TERMS AND CONDITIONS

1. Introduction

Welcome to Sunrise Web Studios LLC. These Terms and Conditions govern your engagement with our agency for web design and development services. By hiring us, you agree to be bound by these terms.

2. Services

We provide digital solutions, including:

  • Web Design & Development: Creating custom websites using WordPress, Divi, and other tools.

  • Website Management: Hosting setup, plugin updates, and content maintenance.

  • Scope of Work: The specific details of your project (deliverables, timeline, and price) will be outlined in your Invoice or Proposal. Any requests outside of that scope will be billed at our standard hourly rate.

3. Payments and Deposits

  • Web Projects: A non-refundable deposit (typically 50%) is required to begin work. The final balance is due before the website goes live or credentials are transferred.

  • Late Payments: Invoices strictly follow the due dates listed. We reserve the right to pause work or take down a live website if payment is more than 14 days overdue.

4. Intellectual Property

  • Your Rights: Upon full payment of the final invoice, the Client owns the copyright to the specific website design and content created for them.

  • Our Rights: We reserve the right to display the completed project in our portfolio and to place a discreet credit link ("Designed by Sunrise Web Studios") in the footer of the site.

5. Client Responsibilities

You agree to provide all necessary text, images, and login credentials in a timely manner. If a project is stalled for more than 30 days due to lack of response or content from the Client, we reserve the right to mark the project as complete and bill for the remaining balance.

6. No Guarantees (Warranties)

  • Website Uptime: While we use high-quality hosting partners, we cannot guarantee 100% server uptime, as this is dependent on third-party providers.

  • SEO Results: We build sites with SEO best practices, but we do not guarantee specific rankings (e.g., "Number 1 on Google") as search algorithms change constantly.

7. Limitation of Liability

In no event shall Sunrise Web Studios LLC be liable for any lost profits, lost data, or incidental damages arising out of the use of our services. Our total liability is strictly limited to the amount paid by the Client for the specific service in dispute.

8. Governing Law

These Terms and Conditions are governed by the laws of the State of New Mexico. Any disputes related to these terms shall be resolved in the courts of Lea County, New Mexico.
